1. Acceptance of Terms

Welcome to ArrivTrack. By accessing or using our school bus tracking service, mobile application, and website (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.

These Terms of Use constitute a legally binding agreement between you and ArrivTrack ("Company," "we," "us," or "our"). We reserve the right to modify these terms at any time, and we will notify users of any material changes via email or through the Service.

2. Description of Service

ArrivTrack provides a school bus tracking and management platform that includes:

  • Real-time GPS tracking of school buses
  • Arrival notifications and estimated times
  • Attendance reporting and management
  • Communication tools between parents, schools, and drivers
  • Emergency alert systems
  • Route management for school districts

The Service is designed to enhance student safety and improve communication between families and schools regarding student transportation.

3. User Accounts

3.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

3.3 Account Types

Different account types (Parent, Student, Driver, School Administrator) have different access levels and responsibilities. You agree to use your account only for its intended purpose.

4. Subscription and Payments

Access to ArrivTrack's premium features requires a paid subscription. By subscribing:

  • You authorize us to charge the payment method on file for the subscription fee
  • Subscriptions are typically billed annually at the start of each school year
  • Refunds are provided on a pro-rata basis as outlined in our refund policy
  • Failure to maintain valid payment information may result in service interruption

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any purpose other than student transportation tracking
  • Share login credentials with unauthorized parties
  • Misuse the emergency alert system for non-emergency purposes
  • Harass, abuse, or harm other users through the messaging features

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection, use, and sharing of information as described in our Privacy Policy, including location data necessary for the GPS tracking functionality.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by ArrivTrack and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

While we strive for accuracy in GPS tracking and arrival time estimates, these are approximations and should not be solely relied upon for critical timing decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARRIVTRACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless ArrivTrack and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. You may request deletion of your data in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which your school district operates, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Service or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
